PİKOLA TUR TOURISM TRAVEL AGENCY DOMESTIC AND INTERNATIONAL PACKAGE TOUR SALES SERVICE AGREEMENT PARTIES AND SUBJECT In this agreement, on one side is Dekatur Tourism Transportation Trade Ltd. Şti. (Pikola Tur), Address: Hacı Miktat Mahallesi Alpaslan Caddesi No:3 Daire: 1 Kat: 101 MERKEZ/ GİRESUN Phone: +90454 2142035 (In this agreement, it will be referred to as Pikola Tur in summary). On the other side is ______________________ residing at the address _______________________ (In this agreement, it will be referred to as the consumer). This agreement has been concluded between the parties in order to regulate the services that the consumer has purchased through Pikola Tur regarding the below-mentioned package tour, including services, payment terms, and the rights and obligations of the parties. Accommodation will be from ________ date to _________ date (....days / ....nights). The names of the individuals to be accommodated are; _____________. The consumer will stay in the tour named ____________________ in a Standard room type ____ pension, with a meal concept included. The total agreement amount including VAT is ________ TL. PAYMENT METHOD ____________. This agreement covers the services specified in the agreement’s appendix and inseparable parts such as the Preliminary Information Brochure, Voucher, Tour Program, and Collection Receipt. The consumer declares that they have examined the tour promotional brochure provided by Pikola Tur for preliminary information purposes before the establishment of this agreement, and they understand the information regarding the tour, the accommodation facility, the total tour price including taxes, the advance payment amount, and the payment date of the remaining amount again within the service package forming the package tour; the starting/end date and location of the journey, the types of transportation used/ to be used and the class of transport, the transport dates, times, and locations, accommodation dates and types, properties, and classifications provided, warnings related to any differences in classification compared to those applied in Turkey, the meal plan, the route to be followed during the journey, the information regarding passport, visa, age, and health requirements in accordance with the features of the package tour, the last date on which the consumer will be informed of the cancellation of the package tour depending on the conditions, 14/9/1972 dated and 1618 numbered Travel Agencies and Travel Agencies Union Law, compulsory insurance information, if any for other insurances, and other details mentioned in the brochure are understandable, a copy of this brochure is attached to this agreement, government agency explanations of the provisions of this agreement have been explained and communicated to them separately, and hence, they state that this agreement has been drawn up and signed in accordance with their declaration of acceptance. The tours or services indicated in the preliminary information and brochure may be subject to extra charges. All package tours' extra tour fees and contents are determined and suggested by local agencies in the cities and countries visited. Extra tours can only be conducted upon sufficient participation, and no compensation and/or refund can be demanded from Pikola Tur due to non-conductance. The consumer agrees to comply with the rules stated by the guide, facility, transportation vehicle, vehicle agency, Pikola Tur officials, and the insurance company related to the purchased service; they will respect the life, property, and peace of third parties, otherwise, they agree that they may justifiably not receive the service, and that they do not have the right to refund. Pikola Tur is not responsible for situations arising from the consumer or personal responsibilities of third parties. Children under the age of 18 must obtain consent from their mother if traveling with their father, or from their father if traveling with their mother; or from both parents if traveling with a third person. Entry into Cyprus, Azerbaijan, and Georgia can be done with a New Identity Card or Passport provided with a passport photo. (Driver's licenses, marriage certificates, etc. are not valid.) If the service is a package tour, instances of missing or completely not providing the package tour are insured according to the 12th article of the 1618 numbered Law. The coverage is up to the package tour price. At the consumer’s request, they may obtain insurance, at their own expense, before the package tour and/or accommodation service starts, covering the costs of returning to the starting point in case of accidents or illnesses, and all kinds of damages and treatment costs arising from any accidents. 1- The consumer who purchases discounted products/special products or promotional products is obliged to pay the full service cost at the time of reservation. The reservation will not be confirmed without complete payment, and visa processes for international tours will not be initiated. For service purchases outside of campaign/special products, at least 30% of the total reservation cost must be paid at the time of registration, and the balance must be paid no later than 15 days before the start of the tour/accommodation/service. If there is less than 15 days between the reservation and the service start date, the full amount will be collected. If these payments are not made within the indicated period, the agreement will be deemed unilaterally terminated by the consumer, in such a case Pikola Tur will make an offset for the advance payment made by the consumer, and issue an invoice. 2- By signing this agreement, the consumer has acknowledged that they will not contest any charges made to the credit card regarding the tour/service amount by Pikola Tur, nor will they file complaints or chargebacks. 3- If there is a price increase in the agreement amount, the excess amount will neither be demanded from the consumer, nor will any discounts referred to by the facility be refunded to the consumer. However, in packages with an agreement amount expressed in foreign currency directed abroad, the consumer agrees that due to extraordinary changes in the foreign exchange rate, changes in taxes, duties, and other legal obligations collected at ports, airports, and similar places, and extraordinary increases in transportation costs including fuel expenditures (in case of more than a 2% price increase, it will be considered as extraordinary), Pikola Tur has the right to change prices and conditions up to a maximum of 5% of the agreed amount. 4- The consumer may transfer their reservation to a third person, who meets all specified conditions, at least 7 days before the date of departure provided that the impossibility of continuing with the purchased tour/accommodation/service be communicated to Pikola Tur. In this case, the transferring person and the person taking over are responsible to Pikola Tur for the remaining balance and any additional costs resulting from this transfer. This situation will be assessed in accordance with the cancellation and change conditions of the transporting airline in case of air travel tours. Particularly regarding transferred tours, the visa fees for consumers whose visa processes have been completed will not be refunded. The visa responsibilities of the consumers who take over the transferred tour will be theirs. In case consumers do not have their visas or fail to obtain a visa from the relevant institution despite applying till the tour start date, Pikola Tur will not accept responsibility, but will collect the full tour amount from the transferring and taking-over parties (jointly). If the person taking over does not have the same status as the transferring one, the transfer will not take place, or the special discounts made will be canceled, and the transfer process will be completed. 5- Before the start of the package tour/service, significant changes made to the content of the agreement for reasons not arising from the consumer, as well as other price etc. changes outside the reasons mentioned in article 3, are considered substantial modifications of the agreement. Pikola Tur may partially or completely change or cancel the reservation before the service starts or during the service for reasons not arising from the consumer. The consumer acknowledges that, in the event of a substantial modification in the essential elements of the agreement, it is sufficient for Pikola Tur to inform them in writing or through a permanent data carrier, and that in such a case, following the notification made to them, they will immediately, in writing or by permanent data carrier: a) participate in another package tour provided by the tour organizer or intermediary, equal to or of higher value without paying additional charges, b) participate in a tour of lower value provided that the price difference is refunded to them, c) If they do not immediately notify Pikola Tur of their intention to use any of these rights or do not explicitly indicate that they wish to use one of these rights, it will be accepted that they have accepted the new conditions contained in this secondary contract that changes the essential elements of the package tour agreement including the price increases notified to them, and the consumer will not be able to demand the refunds of the payments made for services not received on the basis that they did not participate in the tour without any notification. The fees they have paid will be considered as cancellation compensation, which they declare and acknowledge by signing. 6- The consumer hereby states that they have signed the agreement accepting that Pikola Tur will not be held responsible for damages that arise from defaults in performing the contract or failures to provide parts of services even though Pikola Tur exercised due diligence. The consumer also accepts that Pikola Tur will not be held responsible for defaults arising from the acts and deeds of independent service providers (such as accommodation facilities, means of transportation and those who manage them, etc.) and by signing the agreement, they acknowledge that Pikola Tur will not be responsible for damages incurred from such defaults in the event of: a) The existence of the consumer's fault. b) The unexpected and unavoidable action of a third person not involved in the performance of the contract. c) The existence of force majeure. / An event which could not have been foreseen and prevented even though the package tour organizer, intermediary, or independent service provider exercised all due diligence. d) In the case where the minimum participation necessary for the arrangement of the package tour is not met, the contract can be canceled, provided that it has been communicated to the consumer in writing or through a permanent data carrier not less than twenty days before the scheduled start of the package tour (If the reason for the postponement and/or cancellation of the tour arises less than the period before the commencement of the tour, Pikola Tur cannot be held responsible for this.). Pikola Tur has the right to cancel the tour/service by informing the consumer in writing or via permanent data carrier in case the above-mentioned reasons arise before the start of the tour. If the consumer does not accept the postponement or alternative tour proposal from Pikola Tur or if it is actually impossible to postpone the tour, Pikola Tur will refund the payments made by the consumer until that date, excluding official payments made for the consumer (tax, fees, etc.). The consumer cannot make any further claims or rights against Pikola Tur. If unforeseen circumstances arise after the start of the tour, Pikola Tur's responsibility is limited to bringing the consumer back to the starting point of the tour, and no further responsibilities (refund, compensation, etc.) can be imposed upon Pikola Tur. 7- In case of cancellations made by the consumer up to 30 days before the start of the tour/accommodation/service, excluding expenses arising from compulsory taxes, fees, and similar legal obligations that are non-refundable and documented payments to third parties, the amount paid will be refunded to the consumer. In cases of cancellations made by the consumer 29 to 15 days prior to the start of the tour/accommodation/service, the consumer agrees to pay 35% of the reservation fee. For cancellations made less than 14 days prior to the start of the tour, the consumer agrees to pay the full reservation fee to PİKOLA TUR. Cancellations for services obtained during special products in the early reservation stages allow the consumer full refunds for amounts paid until then. If the consumer cancels the contract 59-31 days before service starts, they will pay 25% of the reservation fee; 30-15 days before service starts, they will pay 50% of the tour fee; 14-7 days before service starts, they will pay 75% of the tour amount, and less than 7 days will require full payment to PİKOLA TUR. If the service obtained is a product during special periods (New Year's, mid-term, holiday periods, etc) including other promotions, the cancellation and refund rights of the consumer do not exist. In domestic accommodations, consumers who have purchased early reservation cancellation insurance or early reservation guarantee packages regarding cultural tours can use the uninterrupted cancellation right 72 hours before the start of the service. The early reservation cancellation insurance or early reservation guarantee package do not cover the costs of flights. In cancellations related to international travel, if the visa has been obtained, the visa fee will not be refunded. Upon cancellation requests concerning flight-inclusive tours, this will be evaluated according to the carrier airline's cancellation and change conditions. In cases of consumers requesting changes to the service, if this change is approved by Pikola Tur, if there is a price difference between the previously obtained service and the new service requested, the consumer must immediately pay Pikola Tur the difference upon acceptance of the change request. However, if the price of the new service is lower than the previous service price, Pikola Tur will refund the difference to the consumer. The consumer's health issues coinciding with the service period of themselves or first-degree relatives, documented with an official report from a fully equipped state hospital, or in case of death, will be accepted for refund requests, excluding expenses incurred from compulsory taxes, fees, and similar legal obligations that are non-refundable and documented payments to third parties. The amount paid by the participant will be refunded within 14 business days, provided the request is documented before the start of the service. If this situation occurs after the tour has started, the excuse must be submitted within a maximum of 1 day from the consumer’s departure from the tour. THE AGENCY has the right to cancel or postpone the trip 48 hours prior to the departure time, despite showing all due diligence in situations preventing the trip from starting or continuing due to lack of adequate passenger count and/or adverse weather conditions, road blockage, strikes, terrorism, war threats, unforeseeable technical issues, and all force majeure. In this situation, the consumer has no right to compensation. In day tours, the consumer has the unconditional right to cancel the tour up to 48 hours before the tour date. The consumer is aware that cancellations made after 48 hours will not be refunded by Pikola Tur and date changes are not allowed. Unconditional refunds will be made within 72 hours of the cancellation date. If the consumer does not notify Pikola Tur in writing that they will participate in the tour/accommodation/service they missed starting, Pikola Tur has the right to cancel all reservations and services made in the name of the consumer after 24 hours. No refunds will be made in such cancellations. 8- The responsibility for any luggage and its contents lies solely with the owner. The consumer is obliged to comply with the regulations and customs applicable to the vehicle they will travel in and the facility they will stay in. In case the luggage of the consumer in the vehicles belonging to Pikola Tur is lost or damaged due to intentional fault or gross negligence of Pikola Tur and its employees, with the condition of preparing a loss and damage report, Pikola Tur will pay to the luggage owner the material or moral compensation for the lost item or suitcase up to half of the transportation part of the reservation price, regardless of the material and spiritual value, features and characteristics of the lost or damaged belongings. All other details regarding transportation are arranged and communicated to the consumer in the voucher/brochure. 9- Transportation by Air Regulations regarding charter flights are subject to international aviation rules; airlines reserve the right to change schedules, flight types, and airlines in these flights. The departure time cannot be guaranteed, and the carrier may change stopover points or add stops. Times specified at the time of sale are potential times, and Pikola Tur cannot be held responsible for changes related to this. Therefore, cancellation and refund requests due to these reasons will not be accepted. The refund for unused charter air tickets will not be made due to the nature of the ticket. The regulations for matters not specified in this agreement will be governed by applicable statutory provisions, the IATA, IHA, UFTAA Convention provisions, the Civil Aviation Act, and international treaties to which Turkey is a party, and regulations, directives, circulars, and notifications issued based on these. Pikola Tur serves as an intermediary between the airline and consumers and is subject to the Hague Protocol dated 28.09.1955. Consumers undertake that they acknowledge the risk of schedule changes and accept that they purchase tours with this awareness. As an intermediary institution, Pikola Tur is obliged to notify the consumers as soon as possible after receiving such changes. To avoid any inconvenience, the consumer must contact Pikola Tur at least 48 hours prior to the flight to confirm the flight time. In air transportation, in cases of lost and damaged luggage from the airline, the relevant general rules of the airline apply, and it is explicitly accepted by the consumer that Pikola Tur is not responsible for any such situations. 10- Accommodation Services The consumer acknowledges that they have gathered all the necessary information about the facility where services will be provided under this agreement either from Pikola Tur's web addresses or from Pikola Tur's sales representatives and that they signed after fully inspecting and reading it. In case the facility is unable to provide service on the date when accommodation is due to start, Pikola Tur may propose to accommodate the consumer at a facility with the same standards as the one where the service was purchased. If the consumer does not accept such a change, they have the right to reclaim the total amount paid for their reservation. The number of overnight stays that apply to package tours is valid. In package tours, the first night is counted as the first day and first night. The delays caused by force majeure or by the airline causing delays in transport do not hold Pikola Tur responsible for the consumers not being able to benefit from daylight. It is the responsibility of the consumer to have any luggage, valuables, and similar items in their accommodation facility and to report the necessary reports to the relevant law enforcement agencies. Pikola Tur cannot be held responsible for these and similar situations. If the consumer terminates the service due to a defect in the provided service, they must promptly and in writing inform both the Pikola Tur officials and the hotel where they are accommodated about the reasons for the termination. Otherwise, it will be deemed that the consumer has received and used the service. This situation abolishes the consumer's rights to replacement service, refund of fees, and other compensation rights. 11- The purchased service does not include Visa Procedures and Services. The subject of this section regulates the procedures and principles regarding the provision of visa services that the consumer of the overseas tour requests Pikola Tur to undertake through its authorized agency. Required documents for the visa application process along with the visa expenses and service fees must be delivered by the customer to Pikola Tur and the agency designated by Pikola Tur at least 30 days before the tour departure date. It is mandatory for the delivered passport to have a minimum of a six-month validity period from the start date of the trip. If the consumer delivers their passport and documents to Pikola Tur or its designated agency; they agree to personally appear at the consulate with the provided papers on the requested day and time by the consulate should it be required. If the documents submitted by the consumer to Pikola Tur or the authorized agency are deemed insufficient or lacking by the consulate, the consumer is responsible for all obligations arising from not submitting the requested documents within the specified period. Therefore, The visas that cannot be obtained will not be the responsibility of Pikola Tur and the authorized agency, and any expenses incurred will not be refunded. If the consumer’s documents were submitted on time and the agency applied on time, but the consulate refuses the application or in cases where due to causes not originating from either party the passports are not delivered by the consulate until the starting day of the tour, Pikola Tur or the agency will take no responsibility in this case. In a situation where all responsibilities have been fulfilled by both Pikola Tur, the authorized agency, and the consumer but the visa application is rejected by the consulate, Pikola Tur has the right to collect the full amount of the tour price, visa fee, and service fee if the rejection situation occurs less than 10 days before the start date of the tour. In cases where the consumer violates the good faith rules (such as tax debts, military obligations, travel bans, being on a blacklist, etc.) resulting in not being able to obtain a visa, Pikola Tur or its authorized agency will not be held responsible. All visa procedures will be considered valid, and any customers who are not allowed entry into the country for any reason during their visit or to leave Turkey will not receive any refunds, and Pikola Tur or the authorized agency will not be liable for any damages resulting from this. The consumer is obliged to have a passport that is valid without damage or deformation and will not be held responsible for travel cancellations due to damages or deformations in the passport which arise during exit and entry into the country. A consumer who claims to have a visa for the tour they will be participating in or states that they will personally follow visa procedures cannot terminate the contract citing failure to accomplish visa procedures, and the responsibility lies with the consumer. Pikola Tur and its authorized agency do not have the authority to exert influence or guarantee any outcomes in the consulates. Pikola Tur is not responsible for any delays by the consulates as an intermediary agency. The documents returned by the consulates will be delivered to the consumer by Pikola Tur or its authorized agency. If the consulate does not grant a visa, Pikola Tur assumes no responsibility, and the reason for the visa denial is legally based on the statement of the consulate. 12- The consumer can pay the contract amount in cash or by bank credit cards either in a lump sum or through banks that provide installment payment options for credit cards. In case of payments made by credit card, if the credit card bill is unpaid, the consumer's counterparty is the bank with which they signed the credit card agreement. Pikola Tur is not part of this dispute. Consumers who purchased services through credit cards must inform their bank regarding early payment or payment reduction requests and make these payments at the branches specified by the bank. In case a consumer cancels the service for any reason after their purchase by credit card, Pikola Tur will refund the amount received from the credit card back to the consumer's credit card. The refund process will be carried out according to the rules of banks and will be returned to the consumer's card. In refunds related to installment payments made, banking rules will also apply, and if refunds are to be made in installments and reflected to the card, Pikola Tur does not have any obligation or authority of intervention. 13- Pikola Tur can provide all notifications to the consumer in writing either in person or through a permanent data provider (e-mail, SMS, disk, CD/DVD, memory card, and any similar tools or media). The consumer is obliged to urgently report to the Pikola Tur officials/tour supervisors, in writing, the reasons why the service performed appears to be defective. If the consumer does not report any issues related to the service before leaving the tour/hotel, they will be deemed to have used and received the service without valid reasons, drawing on the presumption of having utilized the service. This eliminates the consumer's rights for replacement services, refund of fees, and claims for damages. If the tour/accommodation/service cannot be completed due to a reason initiating from Pikola Tur after the service has started, Pikola Tur will provide the consumer with alternative arrangements (hotel, etc.) without additional cost to continue the tour. If the consumer accepts the alternative arrangements offered, they cannot demand any refund or compensation. If the consumer does not accept Pikola Tur's alternative arrangements due to defects in the service received, and they wish to withdraw from the agreement, they must notify Pikola Tur in writing and accept that Pikola Tur’s liability for compensation is limited only to the amount corresponding to the services used by the consumer based on the tour price (excluding taxes and transportation costs). 14- Dekatur Tourism Transportation Trade Ltd. Şti. (Pikola Tur) I accept that I have read and understood the Personal Data Processing Enlightenment Text face to face or via any of the means specified in the 4th article of the Distance Contracts Regulation. I am providing this declaration below, without leaving any doubt regarding my explicit consent in compliance with the Law on the Protection of Personal Data No. 6698. I consent to the collection of personal and/or sensitive personal data entirely or partially by your company, subsidiaries, authorized agencies, call centers, affiliated companies, and through all channels, including but not limited to your website and social media pages; to be recorded, stored, changed, updated, periodically checked, rearranged, classified, processed for the purposes necessary or specified by the relevant law, shared and/or transferred abroad with public institutions and organizations legally or operationally obligated to your company and/or third-party service providers, suppliers, insurance companies with whom your company cooperates; and I voluntarily approve the processing of my data with the explicit consent prior to reading this provision _____ / I do not approve _______. 15- Other Provisions The consumer consents and declares to permit the emailing of information regarding campaign announcements by Pikola Tur to the e-mail, mobile, fax, etc. contact details provided at the time of reservation to the Pikola Tur staff and/or websites. Should the consumer declare they do not want any notifications to their personal communication channels, Pikola Tur commits to cease sending emails, SMS, faxes, and postal notifications. All consumers, including children named in this agreement, signed or not, must carry their IDs when participating in the tour and present this package tour/accommodation/service agreement to the reception clerk upon check-in at the hotel. If it is found out that the properties declared (such as age) for children who will stay for free or at a discount according to the criteria set by the facility are incorrect, the consumer will be immediately and completely charged for these children, and any compensations will be sought. The consumer is obliged to comply with the local rules, traditions of the region where the tour is organized, and the conditions and rules of the facility where they will stay. The consumer must comply with the instructions of the tour guide, as well as those of the local authorities, officials of Pikola Tur will provide the tour. The tour guide may change the tour program if deemed necessary. In such cases, the consumer will not have the right to ask for any refunds/compensations from Pikola Tur. Pets will not be accepted in transportation vehicles and accommodation facilities. The consumer must comply with regulations defined for the transportation vehicles and any conditions surrounding luggage (weight, type, amount, etc.) during travel. The consumer accepts that they will respect the rules stated by Pikola Tur, the guide, the transportation vehicle, and facility officials, and not disturb other participants or third parties; otherwise, they will be removed from the tour/facility and cannot make claims against Pikola Tur as a result. The room blockage is made by the facility being stayed at, and Pikola Tur cannot directly intervene. Therefore, Pikola Tur cannot be held responsible for the assigned room to the consumer. If the consumer has purchased a package tour as per Article 12 of the 1618 Law, it is insured that in cases where the service is not performed at all or inadequately, coverage is as per the insurance policy. Additionally, the consumer, if they wish, may obtain additional insurance for emergency or illness covering the costs of returning to the start point, as well as damages and treatment costs arising from any accidents. The consumer is informed of this at the time of signing the agreement and is advised accordingly. Consumers named in the agreement who do not sign but are mentioned in the agreement and are participants in the tour accept that they authorize the consumer signing the agreement to act on their behalf, affirming that all conditions in the agreement will be duly observed. Should they seek to cancel the agreement, the consumer signing will be held accountable for all damages listed. The signing consumer declares that the names of themselves and those whom they have completed the contract on behalf of are correct, and any errors made in supplying information are their responsibility. The travel insurance costs are at the consumer's own expense. The terms for coverage of damages, defects, losses under the travel insurance service bought, or travel insurance included in packages are defined in the policy set forth by the insurance company providing that service; the agency bears no responsibility regarding the contents, scopes, or application of these terms. The parties agree that the addresses specified in this agreement will serve as the notification address, and unless changes are communicated in writing, notifications made to these addresses will be deemed valid. The consumer acknowledges having received all information regarding the contract, tour, the facility will be staying, all corresponding details, and payment in relation to the contract, and having examined them thoroughly, confirming their understanding and acceptance by signing. The consumer agrees that even if they were unable to sign this agreement for any reason, they have made the payment through mail order, a virtual POS, or bank transfer, and that the contract has been sent to them via a permanent data carrier maintains that they reviewed, examined the agreement terms, as well as the associated costs and services, the deposit and installment sale prices for the tour have all been learned through the agency’s catalogue, the website (pikolatur.com), and advertisements. The consumer also affirms and consents that despite not having been able to sign, the agreement has been validated through the permanent data carrier. This agreement, along with the attached reservation form (containing transportation and payment details), constitutes the whole of the contract and all stipulations and provisions herein have been negotiated, understood, and accepted by both parties freely. A copy of the agreement has been provided to the consumer physically or via a permanent data carrier. Both parties confirm that the phone numbers and addresses specified in this agreement are correct, and should any amendments occur, they must be communicated to Pikola Tur in writing or through the methods prescribed in the regulation. Otherwise, Pikola Tur is not responsible for any delays in communicating any necessary information under this agreement. In case of partial or complete non-compliance with the terms of the agreement by Pikola Tur, the amount of damages payable will be determined based on the TÜRSAB Kütahya Scale. The parties agree that the records kept electronically by Pikola Tur along with documents will stand as exclusive evidence corroborated by notes taken by Pikola Tur employees or outside renderers. In cases where there are no provisions in the contract, the provisions of the services provided will apply. The tour registration form, voucher, the informative brochure, and this contract have been incorporated into one whole agreement after being drawn, read, and understood by both parties and accepted. This package tour agreement, consisting of fifteen main articles, has been executed following negotiations between the parties involved.
